ITAC have initiated the sunset review on the anti-dumping duties on Frit classifiable under tariff subheading 3207.40 imported from or originating from Brazil.

Current anti-dumping duties on Frit from Brazil

The anti-dumping duties currently in place are 24.65% for Frit exported by Smalticeram Do Brasil Ltda and 50% for Frit exports by any other Brazilian exporter. The duties have had the effect of removing Brazilian exporters from the SACU market as no commercial quantities of imports from Brazil have taken place apart from the 1 850 kg’s imported from Brazil in March 2015.

Material injury

The industry believes that dumping by Brazilian exporters will resume should anti-dumping duties be removed or expire at the end of their 5 year period in February 2018. According to the initiation gazette, the applicant (Ferro South Africa), provided evidence to show that it would suffer material injury in the form of declining sales, profit, output, productivity, capacity utilisation, net cashflow, employment, and growth, if the anti-dumping duty is removed.

The investigation period for dumping is from 1 July 2016 to 30 June 2017 and the injury investigation involves the evaluation of data for the period 1 July 2014 to 30 June 2017 and 2018 estimates in the event the duty expires.

Interested parties submission deadline

Interested parties have 30 days from today (15 December 2017) to make submissions. However, extensions of not more than 14 days may be granted if good causes are provided.
